ﻓﻲ ﺣﻜﻢ اﻟﻔﺪﻳﺔ ﻭﺑﻴﺎﻧﻬﺎ ﺳﻮاء اﻟﻔﺪﻳﺔ اﻟﻤﺨﺮﺟﺔ ﻋﻦ اﻟﻤﻴﺖ ﻭﻋﻦ اﻟﻤﺮﺿﻊ ﻭاﻟﺤﺎﻣﻞ ﻭاﻟﺸﻴﺦ اﻟﻜﺒﻴﺮ ﻭاﻟﻤﺮﻳﺾ اﻟﺬﻱ ﻻ ﻳﺮﺟﻰ ﺑﺮﺅﻩ ﻭﻣﻦ ﻋﺼﻰ ﺑﺘﺄﺧﻴﺮ ﻗﻀﺎء ﺭﻣﻀﺎﻥ ﺣﺘﻰ ﺩﺧﻞ ﺭﻣﻀﺎﻥ ﺁﺧﺮ ﻭﻣﻦ ﺃﻓﻄﺮ ﻋﻤﺪا ﻭﺃﻟﺰﻣﻨﺎﻩ اﻟﻔﺪﻳﺔ ﻋﻠﻰ ﻭﺟﻪ ﺿﻌﻴﻒ ﻭﻏﻴﺮﻫﻢ ﻣﻤﻦ ﺗﻠﺰﻣﻪ ﻓﺪﻳﺔ ﻓﻲ اﻟﺼﻮﻡ ﻭﻫﻲ ﻣﺪ ﻣﻦ ﻃﻌﺎﻡ ﻟﻜﻞ ﻳﻮﻡ ﺟﻨﺴﻪ ﺟﻨﺲ ﺯﻛﺎﺓ اﻟﻔﻄﺮ ﻓﻴﻌﺘﺒﺮ ﻏﺎﻟﺐ ﻗﻮﺕ ﺑﻠﺪﻩ ﻓﻲ ﺃﺻﺢ اﻷﻭﺟﻪ ﻭﻓﻲ اﻟﺜﺎﻧﻲ ﻗﻮﺕ ﻧﻔﺴﻪ
ﻭﻓﻲ اﻟﺜﺎﻟﺚ ﻳﺘﺨﻴﺮ ﺑﻴﻦ ﺟﻤﻴﻊ اﻷﻗﻮاﺕ ﻭﻳﺠﺊ ﻓﻴﻪ اﻟﺨﻼﻑ ﻭاﻟﺘﻔﺮﻳﻊ اﻟﺴﺎﺑﻖ ﻫﻨﺎﻙ
ﻭﻻ ﻳﺠﺰﺉ اﻟﺪﻗﻴﻖ ﻭﻻ اﻟﺴﻮﻳﻖ ﻭﻻ اﻟﺤﺐ اﻟﻤﻌﻴﺐ ﻭﻻ اﻟﻘﻴﻤﺔ ﻭﻻ ﻏﻴﺮ ﺫﻟﻚ ﻣﻤﺎ ﺳﺒﻖ ﻫﻨﺎﻙ
ﻭﻣﺼﺮﻓﻬﺎ اﻟﻔﻘﺮاء ﺃﻭ اﻟﻤﺴﺎﻛﻴﻦ ﻭﻛﻞ ﻣﺪ ﻣﻨﻬﺎ ﻣﻨﻔﺼﻞ ﻋﻦ ﻏﻴﺮﻩ ﻓﻴﺠﻮﺯ ﺻﺮﻑ ﺃﻣﺪاﺩ ﻛﺜﻴﺮﺓ ﻋﻦ اﻟﺸﺨﺺ اﻟﻮاﺣﺪ ﻭاﻟﺸﻬﺮ اﻟﻮاﺣﺪ ﺇﻟﻰ ﻣﺴﻜﻴﻦ ﻭاﺣﺪ ﺃﻭ ﻓﻘﻴﺮ ﻭاﺣﺪ ﺑﺨﻼﻑ ﺇﻣﺪاﺩ اﻟﻜﻔﺎﺭﺓ ﻓﺈﻧﻪ ﻳﺠﺐ ﺻﺮﻑ ﻛﻞ ﻣﺪ ﺇﻟﻰ ﻣﺴﻜﻴﻦ ﻭﻻ ﻳﺼﺮﻑ ﺇﻟﻰ ﻣﺴﻜﻴﻦ ﻣﻦ ﻛﻔﺎﺭﺓ ﻭاﺣﺪﺓ ﻣﺪاﻥ ﻻﻥ اﻟﻜﻔﺎﺭﺓ ﺷﺊ ﻭاﺣﺪ (ﻭﺃﻣﺎ) اﻟﻔﺪﻳﺔ ﻋﻦ ﺃﻳﺎﻡ ﺭﻣﻀﺎﻥ ﻓﻜﻞ ﻳﻮﻡ ﻣﺴﺘﻘﻞ ﺑﻨﻔﺴﻪ ﻻ ﻳﻔﺴﺪ ﺑﻔﺴﺎﺩ ﻣﺎ ﻗﺒﻠﻪ ﻭﻻ ﻣﺎ ﺑﻌﺪﻩ ﻭﻣﻤﻦ ﺻﺮﺡ ﺑﻤﻌﻨﻰ ﻫﺬﻩ اﻟﺠﻤﻠﺔ اﻟﺒﻐﻮﻱ ﻭاﻟﺮاﻓﻌﻲ
ﻭﻫﻞ ﻳﺠﺰﺋﻪ ﺇﺧﺮاﺝ اﻟﺪﻗﻴﻖ ﻭاﻟﺨﺒﺰ ﻭاﻟﺴﻮﻳﻖ؟ ﻓﻴﻪ ﻭﺟﻬﺎﻥ:
ﺃﺣﺪﻫﻤﺎ: ﻳﺠﺰﺋﻪ؛ ﻷﻧﻪ ﻣﻬﻴﺄ ﻟﻻﻗﺘﻴﺎﺕ.
ﻭاﻟﺜﺎﻧﻲ: ﻻ ﻳﺠﺰﺋﻪ، ﻭﻫﻮ اﻟﺼﺤﻴﺢ؛ ﻷﻧﻪ ﻗﺪ ﻓﻮﺕ ﻓﻴﻪ ﻭﺟﻮﻫﺎ ﻣﻦ اﻟﻤﻨﻔﻌﺔ.
ﻭﺇﻥ ﺃﺧﺮﺝ اﻟﻘﻴﻤﺔ.. ﻟﻢ ﻳﺠﺰﻩ، ﻛﻤﺎ ﻗﻠﻨﺎ ﻓﻲ اﻟﺰﻛﺎﺓ.
